The term "Platform" refers to, but is not limited to, the use of the domain smartatx.com, as well as the smartATX mobile application.

smartATX LLC reserves the right to cancel, suspend, or restrict a user account if the platform is used for inappropriate purposes, including but not limited to:

Use of software to collect information from the site without permission

Altering the website’s functionality or content

Copying, duplicating, or mirroring site information

Interfering with transactions on the platform

Sending unsolicited marketing or spam emails

Identity fraud or impersonation

Using the platform for illegal purposes

Any act that violates applicable U.S. law

Sending threats, hate speech, or abusive messages through the platform

USER REGISTRATION AND PASSWORD

To become a USER on the smartATX platform, all registration form fields must be completed with valid, complete, accurate, and up-to-date information to use the services provided by smartATX LLC.

The USER must ensure that their personal data ("Personal Data") is accurate and commits to updating this data as necessary.

If the USER provides false or inaccurate information, smartATX LLC reserves the right to cancel the user’s account.

smartATX LLC may use various means to verify user identity, such as requesting government-issued identification or other documentation. By accessing the smartATX platform, the USER expressly consents to smartATX LLC validating their personal information with third-party public and private organizations.

The USER is responsible for maintaining the confidentiality of their password and is responsible for any activity associated with their user account and password. The USER acknowledges that their password serves as their electronic signature and that any documented or technical evidence where the password appears has the legal force attributed to it under applicable U.S. law.

If unauthorized use of the account or a data breach occurs, the USER must immediately notify smartATX LLC and describe the circumstances.

LIABILITY

Clients and suppliers using the smartATX LLC platform acknowledge and agree that smartATX LLC is not liable for:

The accuracy of user identity in any transactions conducted on the platform

The quality, existence, condition, or integrity of products and/or services

Product and/or service warranties

The legal capacity of users to enter into contracts

The legitimacy of payment methods used by users

The legal or tax status of users

Users are responsible for the legal acts they engage in through commercial operations on the platform and release smartATX LLC from any damage or loss resulting from these transactions.

INTELLECTUAL PROPERTY RIGHTS

The user expressly authorizes smartATX LLC, free of charge and irrevocably, to use, publish, reproduce, and/or modify images included in product and/or service listings, including commercial names, trademarks, slogans, logos, designs, drawings, and all distinctive signs identifying the user and their products or services.

Any person or entity claiming ownership of intellectual property rights (copyrights, related rights, trademarks, patents, image rights, etc.) may submit a claim to smartATX LLC. Upon receiving a legitimate claim, smartATX LLC will remove the contested goods from the platform.

PRODUCT PRICING

Prices of products and/or services advertised on the smartATX platform are displayed in U.S. Dollars (USD), in accordance with U.S. regulations. Prices include applicable taxes as required by law.

The smartATX platform adheres to international security standards, including Payment Card Industry Data Security Standards (PCI DSS), ensuring secure payment transactions.

BILLING

Users are responsible for providing accurate and complete information for billing purposes. In case of any billing issues, users may contact smartATX LLC via the provided customer service channels.

Users have up to 30 days to request the issuance of an invoice.

ACQUISITION OF SERVICES

By acquiring services on the smartATX platform, the user confirms that the information provided during the acquisition process is accurate and complete. The user agrees to pay the associated costs of services as listed on the purchase page.

USE OF SERVICES

Services provided by smartATX LLC are intended for personal use only. The user must not use the services for any illegal or unauthorized activity. Accessing restricted areas or interfering with the functionality of the services is prohibited.

LIMITATION OF LIABILITY

smartATX LLC and its affiliates will not be liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the smartATX platform. smartATX LLC does not guarantee uninterrupted or error-free access to the platform or the accuracy of the information provided through it.

For AI training and service improvement, smartATX may transmit necessary data securely to third-party service providers.

GOVERNING LAW AND JURISDICTION

These terms and conditions are governed by the laws of the United States and any disputes will be resolved under the jurisdiction of the courts located in the state of Texas.
